TERMS AND CONDITIONS FOR DOMAIN REGISTRATION AND HOSTING SERVICES

1. DEFINITIONS

1.1 “UAESA” refers to UAESA (Pty) Ltd, a company duly registered in South Africa.
1.2 “Client” refers to any person or entity purchasing or subscribing to domain or hosting services from UAESA.
1.3 “Services” include domain registration, management, renewal, hosting, and related support services.
1.4 “Fees” mean charges payable for the provision of domain and hosting services, including setup, renewal, and monthly costs.


2. DOMAIN REGISTRATION, OWNERSHIP & TRANSFER

2.1 UAESA registers domain names on behalf of clients through accredited registrars.
2.2 Unless explicitly transferred or fully purchased by the Client, all domain names registered via UAESA remain the property of UAESA (Pty) Ltd.
2.3 Clients who purchase full ownership rights or initiate a domain transfer to their own registrar will then be recognized as the legal owners of the domain.
2.4 Domains not fully transferred or purchased remain under UAESA’s control, and use is granted to the Client for the duration of their agreement.
2.5 Domain prices vary depending on the extension (e.g., .com, .co.za, .org) and registrar rules.
2.6 All domain registration and renewal fees are subject to annual increases, in line with the official pricing policies of the respective country’s domain authority or registrar board.
2.7 Clients may request domain ownership transfer at any time, subject to payment of all applicable fees and written consent.


3. HOSTING SERVICES AND MONTHLY FEES

3.1 Hosting is offered on a monthly subscription basis, activated upon confirmation of payment.
3.2 Monthly hosting fees are payable in advance and are due on the 1st day of each calendar month.
3.3 Late or missed payments may result in temporary suspension of services, and UAESA reserves the right to terminate services after 14 days of non-payment.
3.4 Clients are encouraged to notify UAESA in advance of any payment issues to avoid service interruption.


4. PAYMENT TERMS

4.1 All payments must be made through approved channels communicated by UAESA.
4.2 Invoices are sent via email to the Client’s registered contact address.
4.3 Reconnection fees may apply after suspension of services due to non-payment.


5. CANCELLATION AND TERMINATION

5.1 Hosting services may be canceled with 30 days’ written notice to domain@uaesa.co.za.
5.2 Domain cancellation, release, or transfer requests must be made in writing and are subject to administrative and registrar fees.
5.3 UAESA reserves the right to suspend or terminate services without notice in cases involving:

  • Violation of these Terms

  • Abuse of services

  • Illegal activity or breach of applicable laws


6. LIABILITY AND INDEMNITY

6.1 UAESA shall not be liable for any direct or indirect damages arising from service interruptions, loss of domain, or data.
6.2 The Client indemnifies UAESA against all liabilities and legal claims resulting from misuse or third-party use of the services provided.


7. CLIENT RESPONSIBILITY AND USE OF DOMAIN

7.1 UAESA acts solely as a registrar and hosting service provider and does not control, monitor, or manage the content or activities conducted via a Client’s domain.
7.2 If a domain registered or hosted under UAESA is found to be engaged in fraudulent, illegal, or unethical activities, UAESA will not be held liable for such actions or their consequences.
7.3 The Client bears full responsibility for the lawful and ethical use of their domain and hosted content.
7.4 UAESA reserves the right to suspend or take down any domain or hosting service that is reported for fraudulent or illegal activities upon receiving credible information or formal notification from law enforcement or regulatory bodies.
7.5 UAESA’s involvement in any domain is strictly limited to registration, DNS management, hosting, and technical maintenance as per Client instructions. We do not endorse, approve, or have knowledge of projects run by the Client unless explicitly contracted to do so.


8. DISPUTE RESOLUTION

8.1 Any disputes arising from or relating to domain registration, hosting services, or these Terms and Conditions shall be addressed and escalated to legal@uaesa.co.za.
8.2 UAESA will make reasonable efforts to resolve any disputes in a timely manner.
8.3 If a dispute cannot be resolved amicably, the Client agrees to pursue all legal remedies available in accordance with South African law.


9. AMENDMENTS

9.1 These Terms and Conditions are subject to change at any time.
9.2 Clients will be notified of changes via email or through the UAESA website. Continued use of services constitutes acceptance of updated terms.


10. GOVERNING LAW

10.1 These Terms shall be governed by the laws of the Republic of South Africa.
10.2 Any dispute shall be resolved through the appropriate courts of South Africa.
